This matter having been opened on the States motion for leave to appeal a pretrial order of the Superior Court, Law Division, and defendants counsel having notified the Court that defendant is deceased, and the State having conceded that defendants death moots the States motion for leave to appeal;
It is hereby ORDERED that the motion for leave to appeal is dismissed as moot.
