I would grant the writ application of Donald Thomas and Go Auto Insurance Company, reverse the lower courts, and remand for new trial. In my view, this application falls squarely within a gross departure from proper judicial proceedings as set forth in La. Sup. Ct. Rule X, Sec. 1(a)(5).
