PER CURIAM
Writ granted. Finding there are genuine issues of material fact still in dispute, we set aside the district courts ruling which granted Occidental Chemical Corporations motion for partial summary judgment and dismissed Texas Brine Companys fraud-based claims. This matter is remanded to the district court for further proceedings.
