We lift the stay order previously issued so that the district court can act expeditiously on defendants motion to proceed in fonna pauperis. We grant defendants application in pah to remand to the court of appeal to reconsider its ruling in light of the outcome, f the proceedings on defendants motion to proceed in forma pauperis.
