Circumstances unique to this case give rise to a genuine issue of material fact and therefore, in my view, the decisions of the lower court are correct. See La. C. Civ. P. art 966(c) and Maggio v. Parker , 17-1112 (La. 6/27/18), 250 So.3d 874.
