STATE of Louisiana v. David Billy PARKER, Jr.

In my view, the trial court did not abuse its discretion in dismissing a juror pursuant to La. C.Cr.P. art. 796 and under unique circumstances presented. Accordingly, I would grant the States writ application, reverse the court of appeal, reinstating the jury verdict sentence imposed by the trial court.
