The issue to be briefed and argued is limited to the following: Did the Court of Appeal correctly declare California Code of Regulations, title 10, section 2076, unconstitutional on its face?
For the purposes of briefing and oral argument, the People are deemed the petitioners in this court. (Cal. Rules of Court, rule 8.520(a)(6).)
The request for an order directing depublication of the opinion is denied. While review is pending, the majority and dissenting opinions in the Court of Appeal will remain published and may be cited for their persuasive value only. (Cal. Rules of Court, rule 8.1115(e)(1).)
