ORDER

Considering the “Motion of New York Life Insurance Company for Damages and Costs for the Filing of a Second Frivolous Application to the Louisiana Supreme Court for a Writ of Certiorari,” IT IS ORDERED that plaintiffs be and hereby are sanctioned pursuant to La. Code Civ. P. art. 2164 for filing a frivolous writ application and are ordered to pay damages in the form of attorney fees and costs to New York Life Insurance Co. IT IS FURTHER ORDERED that the case be remanded to the district court to conduct an evidentiary hearing in order to fix the appropriate amount of damages.

IT IS FURTHER ORDERED that the clerk of this court shall transmit a copy of plaintiffs’ writ application to the Office of Disciplinary Counsel for a determination of whether disciplinary charges against plaintiffs’ counsel are warranted. NEW ORLEANS, LOUISIANA, this _ day of October 2021.
