Opinion

Writ application denied.

I would grant and docket defendants writ application to examine whether there is sufficient evidence to convict under Jackson v. Virginia, 443 U.S. 307, 99 S.Ct. 2781, 61 L.Ed.2d 560 (1979). I am particularly troubled by the five-year-old victims inconsistent reports and her indication that she was incentivized by her grandmother to conduct the CAC interview wherein she reported defendants sexual abuse. Because the victims testimony and statements are the only evidence to support the conviction, the inconsistencies in her statements and this alleged incentive to provide a statement warrant further review by this Court, in my opinion. Accordingly, I would grant and docket in order to permit the Court to review defendants arguments with the benefit of a full record.

Hughes, J., would grant.

Crichton, J., would grant and docket and assigns reasons.

Griffin, J., would grant.
