Opinion

Conditional reinstatement granted. See per curiam.

Considering the recommendation of the hearing committee and disciplinary board as well as the record of these proceedings, we find petitioner is entitled to be reinstated to the practice of law, subject to a two-year period of probation with the following conditions:

1. Within six months of the finality of this order, petitioner shall make a reasonable, good faith efforts to locate the current addresses of Marsha Laws and the Ridley heirs for the purpose of submitting the fee dispute with the heirs to the LSBA Fee Dispute Resolution Program. In the event respondent is unable to locate these persons, he shall make a full report of his efforts to the ODC, and the ODC shall determine whether his efforts were reasonable and in good faith.

2. In additional to his normal mandatory continuing legal education requirements, petitioner shall attend and successfully complete an additional ten hours of mandatory continuing legal education during each year of the probationary period.

Failure to comply with these conditions or any misconduct during the probationary period may be grounds for immediate revocation of respondents conditional reinstatement or imposition of other discipline, as appropriate. All costs of these proceedings are assessed against petitioner.

Weimer, C.J., dissents and would deny reinstatement.
