Writ application denied.

For reasons assigned by Judge McClendon in her dissent, I would grant the writ of the Louisiana Department of Public Safety and Corrections (“DPSC”) thereby reversing the lower courts. Nothing in this record indicates that DPSC itself needlessly incurred costs or engaged in any misconduct that would justify casting it with costs. Crichton, J., would grant and assigns reasons.
