The parties, the attorneys, and the retired judge initiating the contempt proceedings have given the trial judge an unenviable task, which she has handled commendably. However, on the facts before us, there is insufficient evidence to find applicant guilty of contempt of court. The rulings of the lower courts are therefore reversed and the finding of contempt of court is vacated. REVERSED. JUDGMENT OF CONTEMPT VACATED.
Because I find Judge Robert Waddells order sufficiently clear, and in light of Judge Karelia Stewarts meticulous review of the evidence, I would deny this application. This lawyer repeatedly refused to comply with the trial courts instructions and he has not demonstrated any error in the lower courts’ findings. Accordingly, I dissent from the majoritys reversal of the contempt adjudication. Crichton, J., dissents and assigns reasons.
