In Gonzales v. Trevino, 602 U.S. ---, 144 S. Ct. 1663 (2024), the Supreme Court vacated the panel majoritys reversal of the District Courts denial of a motion to dismiss and remanded “for the lower courts to assess whether Gonzalezs evidence suffices to satisfy the Nieves exception.” Id. at 1668. Accordingly, we REMAND this case to the District Court for further proceedings consistent with the Supreme Courts opinion.
