ORDER DISMISSING APPEAL
This is an appeal from a judgment of conviction. Second Judicial District Court, Washoe County; Egan K. Walker, Judge.
Appellants counsel has filed a notice of withdrawal of appeal, which substantially complies with NRAP Form 8. Counsel advises this court she has informed appellant of the legal effects and consequences of the voluntary withdrawal of this appeal, which include the inability to reinstate the appeal and that any issues raised in this appeal are forever waived. Counsel has also explained post-conviction procedures and the right of appellate review. Having been so informed, appellant has elected to voluntarily withdraw this appeal. Accordingly, cause appearing, we order this appeal dismissed. Because no remittitur will issue in this matter, see NRAP 42(b), the one-year filing period for filing a post-conviction habeas petition under NRS 34.726(1) shall commence to run from the date of this order. The conditional sanctions imposed in this courts March 28, 2024, order are vacated.
