ORDER
Considering the Motion for Reinstatement to the Practice of Law filed by respondent, David Band, Jr.,
IT IS ORDERED that respondent shall be conditionally reinstated to the practice of law, subject to a one-year period of probation with the following requirements:
(1) As soon as practicable following the rendition of this order, upon respondents recommendation and the ODCs approval, the ODC shall appoint a practice monitor to supervise respondents professional activities during the probationary period. Respondent shall comply with all reasonable requests of his practice monitor.1 (2) Petitioner shall cooperate with the ODC, and shall comply with any and all requirements imposed upon him by the ODC, including, but not limited to, additional evaluation by the Judges and Lawyers Assistance Program.
(3) Upon the expiration of the current conditional reinstatement period, the ODC shall file a report in this court in which it shall recommend whether the conditional reinstatement shall be allowed to terminate or shall be extended.
Should respondent fail to comply with these conditions, or should he commit any misconduct during the period of probation, his conditional reinstatement to practice may be terminated immediately, or he may be subjected to other discipline pursuant to the Rules for Lawyer Disciplinary Enforcement, as appropriate.
