SUPREME COURT OF LOUISIANA

No. 2024-KK-00475

STATE OF LOUISIANA

VS.

JALEEL GREEN

On Writ of Certiorari to the Court of Appeal, Fourth Circuit, Parish of Orleans Criminal

PER CURIAM

Writ granted. The trial court erred in granting defendants motion to suppress evidence based on the failure to first Mirandize defendant before asking him whether he was armed during a brief investigatory detention justified by reasonable suspicion. We adopt the reasons of Judge Lobrano, dissenting in the court of appeal. State v. Green, 24-169, pp. 1-15 (La. App. 4 Cir. 4/16/24) (Lobrano, J., dissenting). See also La.C.Cr.P. art. 215.1(B); State v. Wade, 390 So.2d 1309 (La. 1980). Griffin, J., dissents and would deny.
