IN RE: DAVID J. MOTTER

ON APPLICATION FOR REINSTATEMENT

PER CURIAM

On April 12, 2022, we accepted a petition for consent discipline and suspended petitioner from the practice of law for three years, with all but one year and one day deferred. In re: Motter, 21-1779 (La. 4/12/22), 335 So. 3d 830. Petitioner now seeks reinstatement to the practice of law.

Having considered the recommendation of the hearing committee, as well as the record of these proceedings, we find petitioner has met his burden of proving that he is entitled to be reinstated to the practice of law. Accordingly, we will reinstate petitioner to the practice of law, subject to an eighteen-month period of probation, with the following conditions:

1. Petitioner shall honor his obligation to pay the 2023-2024 bar dues and disciplinary assessment;

2. Petitioner shall pay all disciplinary costs both previously incurred and presently owed to the disciplinary board and honor the terms of any promissory note(s) with the board; and

3. Petitioner shall honor his obligation to repay the Client Assistance Fund the monies it has paid his prior clients.

DECREE

Upon review of the recommendation of the hearing committee, and considering the record, it is ordered that David J. Motter, Louisiana Bar Roll number 21366, be immediately reinstated to the practice of law in Louisiana, subject to an eighteen-month period of probation with the conditions set forth herein. Should petitioner fail to comply with the conditions of probation, his conditional right to practice may be terminated immediately, or he may be subjected to other discipline pursuant to the Rules for Lawyer Disciplinary Enforcement, as appropriate. All costs of these proceedings are assessed against petitioner.
