ORDER DISMISSING APPEAL
This appeal was initiated by the filing of a pro se notice of appeal. Second Judicial District Court, Washoe County; Egan K. Walker, Judge.
This courts review of this appeal reveals a jurisdictional defect. Appellant appears to have filed a notice of appeal to this court from an order of the court of appeals, Short v. State, Docket No. 85906-COA (Order of Affirmance, June 13, 2023). Appellant cannot appeal to this court from an order of the court of appeals. See Castillo v. State, 106 Nev. 349, 792 P.2d 1133 (1990) (right to appeal is statutory; where no statute or court rule provides for an appeal, no right to appeal exists). To the extent, if any, appellants notice of appeal can be construed as a petition for review or rehearing of the order in Docket No. 85906-COA, it is untimely. NRAP 40(a)(1); NRAP 40B(c). This court lacks jurisdiction and ORDERS this appeal DISMISSED.
