PER CURIAM.

Tommy Ray Combs appeals the district court’s order dismissing his civil action as frivolous, for failure to state a claim, and as barred by res judicata. We have reviewed the record and the district court’s opinion accepting the magistrate judge’s recommendation to dismiss the complaint and find no reversible error. Accordingly, we affirm on the reasoning of the district court. See Combs v. Ashe County Health Dep’t, No. CA-00-100-5-V (W.D.N .C. Nov. 13, 2000). We further deny Comb’s motion for the appointment of counsel. We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process.

AFFIRMED.
