To compel a highway commissioner to build a bridge.

Denied, without prejudice, May 6, 1891.

Delator, highway commissioner of the township of Columbus, sought to compel respondent as highway commissioner of the township of Casco, to build a bridge under an agreement made some years before apportioning the highway. Negotiations had for some time been earned on between the township boards, and there was no allegation that any provision had been made for the expense of such construction.
