Relator presented tbe bond April 12, 1886. Tbe matter was deferred until May 3, 1886, on which day an ordinance of the village, passed April 9, 1886, took effect and respondents base their refusal upon the ordinance. Held, that as the statute required relator to file his bond on or before May 1, it was the duty of respondents to act upon it before that date and that said ordinance had no force until May 3.
