Per Curiam:
Prom the evidence offered by the plaintiff in error, who was defendant below, it is clear that the alleged gift was executory, and to be consummated by a deed which was not executed until after the conveyance to Patterson. His case was thus brought within the bar of the statute, and the court below properly directed a verdict for the plaintiff. The judgment is affirmed.
