Opinion

majority opinion

Per Curiam:

As this case involved a trust, the equity side of the court of common pleas had jurisdiction, and the learned judge properly construed the deed of the 10th of March, 1863, as vesting an equitable estate in fee in Mary McCombs. Decree affirmed, and appeal dismissed at the costs of the appellants.
