Opinion

majority opinion

Per Curiam:

As the bequest in this case vested in Mary A. Harper not only the equitable but legal title in the stocks and bonds bequeathed, the trust, if indeed it can be regarded as such, was executed in the donee at the time of its creation; hence the trustee had nothing whatever in the subject-matter of it. The decree is affirmed and the appeal dismissed, at the costs of the appellant.
