Per Curiam :
This is rather a close case; but, under the modern authorities in this state, we think the evidence presented a case proper for the jury. The occupation of the vendee was such that it was difficult for him to have any other possession of the property-than that which he had, without depriving himself of the convenient use thereof. The evidence was submitted in a correct manner.
Judgment affirmed.
