Per Curiam:
There is technical error in that portion of tbe charge covered by tbe fifth assignment of error, but in view of other portions of the charge and the whole evidence, no injustice was done to the plaintiff. No error is found sufficient to demand a reversal of the judgment; substantial justice was done by the verdict and .judgment thereon. Judgment affirmed.
