Per Curiam,
According to the finding of the learned judge who tried this case, by which we are bound, the rule was properly discharged. We may also add that an examination of the evidence leads us to believe that those findings were substantially correct. As a consequence, none of the assignments can be sustained. The decree is affirmed at the costs of appellant.
