Opinion

majority opinion

By the Court.

When a bill of exceptions refers to an exhibit attached to and made part thereof, only as containing the testimony admitted at the trial, the reviewing court can not consider any statement in said exhibit purporting to recite rulings, admitting or excluding evidence made by the court before which the case was tried. Motion overruled.
