Per Curiam.
The appellant having failed to file a transcript of the record, within the time required by the 12th rule of this court, it is considered that the appeal be dismissed, and that a copy of this order be certified to the clerk of the Morgan circuit court, and that the defendant recover his costs. Appeal dismissed.
