Opinion

majority opinion

Cobb, P. J.

1. The alleged newly discovered evidence was cumulative and impeaching in its character, and the discretion of the judge exercised in refúsing to grant a new trial upon this ground will not be controlled. 2. The other rulings complained of were not erroneous for any of the reasons assigned. The evidence authorized the verdict, and no sufficient reason has been shown for reversing the judgment. Judgment affirmed.

All the Justices concur.
