—The Court are unanimously of the opinion, under the circumstances of this case and in view of the statute cited by Mr. Cooper—and by that parity of reasoning applying it to this case—that we ought not to continue this case to the next term. (The Attorney-General thereupon entered a nolle prosequi as to each of the said defendants.)
